When you create an account, subscribe to a plan, or use our Service, we may collect:

- Business content: Lead magnets, email templates, SMS message content, and marketing materials you upload or create through the Platform

1.2 Information Collected Through Your Use of the Service
When leads interact with your campaigns through our Platform, we collect and process on your behalf:
- Lead data: Names, email addresses, phone numbers, and other information submitted through lead capture forms
- Engagement data: Email open rates, click-through rates, SMS delivery status, and form submission timestamps
- Source data: The platform or channel from which a lead originated (e.g., Instagram, Facebook, TikTok, landing page)
1.3 Voice AI Data
If you use our Voice AI Agent add-on service, we additionally collect:
- Call recordings: Audio recordings of Voice AI conversations with leads
- Call transcripts: Text transcriptions of Voice AI calls
- Call metadata: Call duration, timestamps, phone numbers dialed, and call outcomes (e.g., appointment booked, voicemail left, no answer)
- Usage data: Minutes consumed, overage amounts, and billing-related usage metrics
1.4 SMS Data
When you use SMS features through our Platform, we collect and process:
- Phone numbers: Recipient phone numbers provided by you or submitted through lead capture forms
- Message content: The text content of SMS messages sent through the Platform
- Delivery data: Message delivery status, timestamps, and carrier responses
- Usage data: Message counts per billing cycle for usage tracking and overage billing
1.5 Automatically Collected Information
When you or your leads visit our website or use the Service, we may automatically collect:
- Device information: Browser type, operating system, and device type
- Log data: IP addresses, access times, pages viewed, and referring URLs
- Cookies: Session cookies for authentication and preferences (see Section 7)
2. How We Use Your Information
We use the information we collect for the following purposes:
- Service delivery: To operate, maintain, and provide the features of the Platform, including lead capture, email delivery, SMS messaging, Voice AI calls, and appointment booking

We do not sell, rent, or trade your personal information or your leads’ personal information to third parties for marketing purposes.

If Digital Automations AI is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such change and any choices you may have regarding your information.
4. Data Storage and Security
4.1 Where Data Is Stored
Our Platform infrastructure is hosted on servers located in North America. Some third-party services we use may store data in other jurisdictions. By using the Service, you consent to the transfer of your information to these locations.
4.2 Security Measures
We implement reasonable technical and organizational measures to protect personal information, including:
- SSL/TLS encryption for all data transmitted between your browser and our servers

5. Data Retention
5.1 Account Data
We retain your account information for as long as your account is active. If you cancel your subscription, we may retain your account data for up to 90 days to allow for reactivation, after which it will be deleted unless retention is required by law.
5.2 Lead Data
Lead data stored in your CRM is retained for the duration of your active subscription. Upon account termination, lead data will be deleted within 90 days unless you request earlier deletion or export.
5.3 Voice AI Recordings
Voice AI call recordings and transcripts are retained for up to 90 days for quality assurance and dispute resolution purposes, unless a longer retention period is required by law or requested by you.
5.4 SMS Records
SMS message logs and delivery data are retained for up to 12 months for billing verification and compliance purposes.
5.5 Billing Records
Payment and billing records are retained for up to 7 years as required by Canadian tax and financial reporting regulations.
6. Your Rights
Under PIPEDA and PIPA, you have the following rights regarding your personal information:
- Access: You may request a copy of the personal information we hold about you
- Correction: You may request that we correct inaccurate or incomplete personal information
- Deletion: You may request that we delete your personal information, subject to legal retention requirements
- Withdrawal of consent: You may withdraw your consent to the collection, use, or disclosure of your personal information at any time, subject to legal or contractual restrictions. Withdrawal of consent may affect our ability to provide the Service to you
- Data portability: You may request an export of your lead data in a commonly used electronic format

- Obtaining valid consent (express or implied) from your leads before sending commercial electronic messages through the Platform
- Including accurate sender identification and a functioning unsubscribe mechanism in all commercial messages
- Honoring unsubscribe requests within 10 business days
- Maintaining records of consent for your leads
LeadTracker provides tools to help you comply with CASL, including unsubscribe link functionality and consent tracking. However, you are solely responsible for your compliance with CASL and all other applicable anti-spam laws.
9. Your Responsibility for Lead Data
As the data controller, you are responsible for:
- Obtaining proper consent from leads before collecting their personal information
- Providing your leads with your own privacy policy or privacy notice
- Complying with all applicable privacy laws in your jurisdiction
- Ensuring that any Voice AI calls comply with call recording notification requirements
- Responding to privacy-related requests from your leads
10. Children’s Privacy
Our Service is not directed to individuals under the age of 18. We do not knowingly collect personal information from children. If you become aware that a child has provided us with personal information, please contact us immediately and we will take steps to delete such information.
11. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. We will notify you of material changes by:
- Posting the updated policy on our website
- Updating the “Last Updated” date at the top of this page
- Sending an email notification for significant changes
