Welcome to LeadTracker.co, a lead capture and automation platform operated by Digital Automations AI (“Company,” “we,” “us,” or “our”). By accessing or using our Service, you agree to be bound by these Terms of Service (“Terms”). Please read them carefully.
1. Agreement to Terms
By creating an account, accessing, or using LeadTracker.co (the “Platform” or “Service”), you acknowledge that you have read, understood, and agree to be bound by:

If you do not agree to these Terms, you may not use our Service.
If you are using the Service on behalf of an organization (such as a business, agency, or partnership), you represent and warrant that you have the authority to bind that organization to these Terms.

LeadTracker.co provides a lead capture and automation platform designed to help service-based businesses capture, nurture, and convert leads. Our services include:
- Lead capture from multiple channels (social media, landing pages, forms)
- Automated lead magnet delivery via email, DM, and SMS
- Email nurture sequences and follow-up automation
- CRM and lead management tools
- Strategy call booking automation
- SMS notifications and confirmations
- AI-powered Voice Agent services (optional add-on)
- Reporting and analytics tools
3. User Accounts
3.1 Account Creation
To use certain features of the Service, you must create an account and subscribe to a plan. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account at info@leadtracker.ca.
3.3 Account Types
The Service provides different subscription tiers with varying features and capabilities as described on our pricing page.
4. User Responsibilities
4.1 Accurate Information
You agree to provide truthful, accurate, and complete information when using the Service, including but not limited to business details, contact information, and lead magnet content.
4.2 Compliance with Laws
You agree to comply with all applicable federal, provincial, and local laws and regulations, including but not limited to Canada’s Anti-Spam Legislation (CASL), the CAN-SPAM Act (if applicable), and all applicable privacy and data protection laws. You are solely responsible for obtaining appropriate consent from leads and contacts before sending marketing communications through our platform.
4.3 Proper Use
You agree to use the Service only for its intended purposes and in accordance with these Terms. You are responsible for all content, lead magnets, and communications sent through the platform.
4.4 Lead Magnet Content
You are solely responsible for the content of any lead magnets, guides, emails, and communications distributed through the Service. Digital Automations AI does not review, endorse, or assume liability for user-created content.
5. Prohibited Uses
You agree NOT to:
- Submit false, misleading, or fraudulent information
- Send unsolicited or spam communications through the Service
- Use the Service to collect leads without proper consent
- Impersonate any person or entity
- Access accounts or data belonging to others without authorization
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to any part of the Service
- Use the Service for any unlawful purpose
- Transmit viruses, malware, or other harmful code
- Scrape, harvest, or collect data from the Service without permission
- Reverse engineer or attempt to extract source code from the Service
- Use automated systems (bots, scrapers) to access the Service without authorization
- Circumvent any access controls or security measures
- Distribute content that infringes on intellectual property rights of third parties
6. Voice AI Agent Services
6.1 Service Description
The Voice AI Agent is an optional add-on that places automated phone calls to leads on your behalf. The agent uses your business name and information to conduct personalized conversations and book appointments.
6.2 Usage and Billing
Voice AI usage is metered by call minutes. Your plan includes 30 minutes of call time per month. Minutes used beyond the included 30 minutes are billed at $0.15 per minute. Automatic actions are triggered at the following usage thresholds:

The default monthly hard cap is 60 minutes. To increase your cap, you must contact LeadTracker and either prepay for additional minutes or agree in writing to a higher monthly limit. Failed overage payments will result in immediate agent suspension.
6.3 Call Recording and Data
Voice AI calls may be recorded and transcribed for quality assurance and service improvement. You are responsible for informing your leads that calls may be recorded where required by law.
6.4 Compliance
You are responsible for ensuring that AI-initiated calls comply with all applicable telecommunications regulations, including do-not-call requirements and consent obligations in your jurisdiction.
7. Intellectual Property
7.1 Our Content
The Service, including its design, features, functionality, text, graphics, logos, and software, is owned by Digital Automations AI and protected by copyright, trademark, and other intellectual property laws. The LeadTracker name, logo, and all related marks are trademarks of Digital Automations AI.
7.2 Your Content
You retain ownership of any content you submit to the Service, including lead magnets, business information, and marketing materials. By submitting content, you grant Digital Automations AI a non-exclusive, worldwide, royalty-free license to use, store, process, and display that content as necessary to provide the Service.
7.3 Feedback
Any feedback, suggestions, or ideas you provide about the Service may be used by us without any obligation to you.
8. Privacy and Data
Your use of the Service is governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy.
We comply with:
- Personal Information Protection and Electronic Documents Act (PIPEDA)
- British Columbia’s Personal Information Protection Act (PIPA)
- Canada’s Anti-Spam Legislation (CASL)
9. Third-Party Services
The Service integrates with third-party services, including:
- Social media platforms (Instagram, Facebook, TikTok)
- Communication services (SMS, email delivery)
- Calendar and scheduling services
- Payment processors (Stripe)
- AI and voice services
- Cloud hosting providers
Your use of third-party services is subject to their respective terms and privacy policies. Digital Automations AI is not responsible for the practices of third parties.
10. Service Availability
10.1 No Guarantee
We strive to maintain reliable service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
10.2 Modifications
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.
10.3 Support
We provide customer support through email and our contact form. Support availability and response times may vary.
11. Fees and Payment
11.1 Subscription Plans
Access to the Service requires a paid subscription. Subscription plans and pricing are as described on our website and may be updated from time to time with notice.
11.2 Billing
Subscriptions are billed on a recurring monthly basis through our payment processor (Stripe). You authorize us to charge your payment method on file for all applicable fees.
11.3 SMS Usage & Overage
Each subscription plan includes a set number of SMS messages per month:

SMS messages sent beyond the included monthly allocation are billed at $0.03 per message. Overage charges are invoiced automatically at the end of each billing period, or when overage charges exceed $15.00, whichever comes first. All overage charges are billed to the payment method on file with Stripe.
You will receive a notification when you have used 80% of your included SMS allocation. If your payment method is declined for SMS overage charges, SMS functionality may be suspended until the outstanding balance is resolved.
SMS allocations reset at the beginning of each billing cycle. Unused messages do not roll over to the following month.
11.4 Add-On Services
Optional add-on services (such as Voice AI) are billed separately as specified at the time of activation. Usage-based charges (such as Voice AI call minutes) are billed in arrears. See Section 6 for Voice AI billing details.
11.5 Late Payments
Late payments may result in service suspension or termination. We reserve the right to charge interest on overdue amounts at a rate of 1.5% per month or the maximum rate permitted by applicable law, whichever is less.
11.6 Refunds
Subscription fees are generally non-refundable except where required by law. If you cancel your subscription, you will retain access until the end of your current billing period. Overage charges (SMS and Voice AI) are non-refundable as they reflect actual usage already incurred.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
DIGITAL AUTOMATIONS AI, LEADTRACKER.CO, AND THEIR OWNERS, OPERATORS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM:
- Your use of or inability to use the Service
- Loss of leads, prospects, or business opportunities
- Delivery failures of emails, SMS messages, or voice calls
- Actions or inactions of any user or lead
- Unauthorized access to or alteration of your data
- Any third-party conduct on the Service
- Inaccurate or incomplete lead data
- Results or outcomes from using the Service
OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED CANADIAN DOLLARS ($100 CAD).

13. Indemnification
You agree to indemnify, defend, and hold harmless Digital Automations AI, LeadTracker.co, and their officers, directors, employees, contractors, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any applicable law or regulation, including CASL
- Any content or lead magnets you distribute through the Service
- Your infringement of any third-party rights
- Communications sent to leads through the Service
- Claims from leads or contacts arising from your marketing practices
14. Termination
14.1 By You
You may terminate your account at any time by contacting us at info@leadtracker.ca. Termination does not relieve you of any obligations incurred prior to termination, including outstanding payment obligations for SMS or Voice AI overage charges.
14.2 By Us
We may suspend or terminate your account at any time for:
- Violation of these Terms
- Non-payment of fees, including overage charges
- Sending spam or unsolicited communications
- Fraudulent or illegal activity
- Extended inactivity
- Any other reason at our reasonable discretion
14.3 Effect of Termination
Upon termination:
- Your right to use the Service ceases immediately
- Any outstanding overage charges (SMS or Voice AI) become immediately due and payable
- We may delete your account and associated data after a reasonable retention period
- Provisions that by their nature should survive termination will remain in effect
15. Dispute Resolution
15.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of British Columbia, Canada, without regard to conflict of law principles.
15.2 Informal Resolution
Before initiating formal proceedings, you agree to first contact us at info@leadtracker.ca to attempt to resolve the dispute informally.
15.3 Arbitration
Any dispute arising from these Terms or your use of the Service that cannot be resolved informally shall be resolved through binding arbitration in British Columbia, in accordance with the Arbitration Act (British Columbia).
15.4 Class Action Waiver
You agree that any dispute resolution will be conducted on an individual basis and not as a class action, collective action, or representative proceeding.
15.5 Jurisdiction
For any disputes not subject to arbitration, you consent to the exclusive jurisdiction of the courts of British Columbia, Canada.
16. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by:
- Posting the updated Terms on the Service
- Updating the “Last Updated” date
- Sending an email notification for significant changes
Your continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.
17. General Provisions
17.1 Entire Agreement
These Terms, together with our Privacy Policy and Liability Disclaimer, constitute the entire agreement between you and Digital Automations AI regarding your use of LeadTracker.co.
17.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
17.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
17.4 Assignment
You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations without restriction.
17.5 Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, acts of government, or internet outages.
